This page is maintained by The Growth Mindset Network (“TGMN,” “we,” “us,” or “our”) to describe the terms that apply when you use our website, portals, and programs. It is written in plain language and is not legal advice — for advice about your specific situation, please consult your own attorney.

1. Introduction

The Growth Mindset Network is a nonprofit that connects donors, youth program providers, facilitators, and corporate partners. These terms apply to anyone who visits the site, creates an account, donates, applies for accreditation, purchases training, submits a vendor proposal, or otherwise interacts with the network.

By using the site or any portal, you confirm that you have read these terms and agree to be bound by them. If you do not agree, please do not use the site.

2. Acceptance of these terms

Using the network — including browsing public pages, creating an account, submitting documents, making a donation, or buying training — means you accept these terms and any additional terms that appear at the point of use (for example, course refund windows or donation receipts).

3. Eligibility & accounts

You must be at least 18 years old to create an account. Information you provide must be accurate, current, and complete. You are responsible for maintaining the confidentiality of your credentials and for all activity that happens under your account. Notify us promptly if you suspect any unauthorized access.

Organization accounts may only be created by someone authorized to act on the organization’s behalf.

4. Participant waiver & release of liability

Youth enrichment activities — sports, outdoor adventure, arts, mentorship, and similar programs — carry inherent risks that cannot be eliminated. By enrolling a participant or allowing a participant to take part in a program listed in or facilitated through the network, the participant and their parent or legal guardian acknowledge those risks.

To the fullest extent permitted by law, the participant and their parent or guardian release and discharge The Growth Mindset Network, its directors, officers, employees, volunteers, providers, and facilitators from any and all claims, demands, or causes of action arising out of ordinary negligence in connection with the program. This release does not waive any claim that cannot legally be waived.

5. Hold harmless & indemnification

You agree to defend, indemnify, and hold harmless The Growth Mindset Network and its directors, officers, employees, and volunteers from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of the site or portals;
  • any content, documents, or information you submit;
  • your violation of these terms or any applicable law;
  • your conduct off the platform, including the operation of your program, services, or business.

6. Use of images & likeness

Photos, video, logos, and other imagery you submit to the network (provider photos, facilitator badges, event coverage, testimonials) may be used by TGMN for promotion, accreditation displays, social media, and other communications that support the mission.

If a minor is depicted, the person submitting the image warrants that they are the parent or legal guardian or have obtained that consent. To opt out of future use, email us and we will remove the image from network-controlled channels going forward.

7. Provider responsibilities & EIN handling

Program providers warrant that they have authority to submit their organization’s information and that the information submitted is accurate.

EINs (Employer Identification Numbers) are collected for verification purposes and are displayed only inside the provider’s own portal. EINs are not shown on public verification pages, badges, or other public-facing parts of the network.

In the event of a security breach, account compromise, phishing attempt, or other unauthorized access — whether to our systems or to the provider’s own credentials, devices, or accounts — TGMN disclaims, to the fullest extent permitted by law, any responsibility for fraud, identity theft, financial loss, or other misconduct perpetrated by a third party against the provider, its staff, donors, families, or any other person.

8. Facilitator purchases & training fees

Facilitator certifications and training materials are sold through the network at the prices listed at checkout. Unless a course page states otherwise, purchases are final once course access is delivered. Refund requests made at least 14 days before a scheduled course start may be honored at our discretion.

Digital course access and earned facilitator badges are tied to the individual account and are non-transferable.

9. Donations

Donations are voluntary and non-refundable. Tax receipts are issued automatically to the email on file. The Growth Mindset Network is a recognized nonprofit (FEIN 39-3475441); please retain your receipt for your records and consult your own tax advisor regarding deductibility.

10. Vendor proposals & corporate partnerships

Vendor and corporate partnership submissions are reviewed at TGMN’s sole discretion, and submission does not create any obligation on our part to engage, partner with, or compensate the submitter. Vendors retain ownership of the intellectual property in their proposals but grant TGMN a non-exclusive, royalty- free license to review the submission and share it internally with the board and reviewers.

11. User content & conduct

You agree not to submit content that is unlawful, harassing, defamatory, sexually explicit, hateful, fraudulent, or otherwise contrary to the mission of the network. We may remove content, suspend access, or terminate accounts that violate these terms, at our discretion.

12. Information & data protection

We use reasonable administrative, technical, and physical safeguards to protect the information stored in the platform. You are responsible for keeping your login credentials secure and for the security of the device and email account you use to access the network.

No internet-based system can be guaranteed to be 100% secure. See section 7 regarding responsibility in the event of a breach or unauthorized access.

13. Third-party services

The network relies on third-party services for payments, email delivery, analytics, hosting, and similar functions. Your use of those services is also subject to their own terms and privacy practices. We are not responsible for the practices of third parties.

14. Disclaimers

The site, portals, training, and any program listings are provided on an “as is” and “as available” basis. TGMN does not guarantee any particular outcome from participating in a program, completing training, or appearing in the network directory.

15. Binding arbitration & class-action waiver

Any dispute arising out of or relating to these terms or your use of the network that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Missouri. Judgment on the award may be entered in any court of competent jurisdiction.

You and TGMN each waive the right to a jury trial and the right to participate in a class, collective, or representative action. Either party may bring a qualifying claim in small-claims court instead of arbitration.

You may opt out of this arbitration provision within 30 days of first accepting these terms by emailing us with your name, account email, and a clear statement that you are opting out.

16. Governing law & venue

These terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws principles. For any claim that is not subject to arbitration, the exclusive venue will be the state or federal courts located in Missouri, and each party consents to personal jurisdiction there.

17. Changes to these terms

We may update these terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the network after an update constitutes acceptance of the revised terms.
